BEFORE: JONES and CONTIE, Circuit Judges; and PECK, Senior Circuit Judge Order The petitioner appeals the judgment denying his petition for a writ of habeaus corpus under 28 U.S.C. § 2241. The appeal was referred to this panel pursuant to Rule 9(a), Rules of the Sixth Circuit. Upon consideration of the records and briefs, this panel agrees unanimously that oral argument is not required. Rule 34(a), Federal Rules of Appellate Procedure. The petitioner was convicted in 1977 for the distribution of heroin and sentenced to seven years imprisonment and a special parole term of three years. In August, 1982, he was released from parole stemming from the seven year sentence and began serving the special parole sentence. In November, 1982, he was arrested on state charges of trafficking in marijuana. Seized at the petitioner's residence at the time of his arrest were 26 pounds of marijuana and two firearms -- a .12 gauge shotgun and a .22 caliber rifle. He pleaded guilty to the state charge and received a sentence of 3-10 years imprisonment.
